Terms & Conditions

Last updated 16 August 2026. These terms form an agreement between you and Batsysmail (“we”, “us”), the operator of Batsysmail.

1. Acceptance

By creating an account or continuing to use Batsysmail you agree to these terms. If you accept on behalf of an organisation, you confirm you have authority to bind it. If you are an individual, you confirm you are of legal age.

2. The service

Batsysmail lets you store contacts, build audiences and send email and SMS campaigns, subject to the limits of your plan. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.

3. Your account

You must provide accurate information, keep it up to date and keep your credentials confidential. You are responsible for all activity under your account.

4. Acceptable use

  • No unlawful use, fraud, phishing or unsolicited bulk messaging (spam).
  • You must have documented consent from every contact you upload or message, and you must honour unsubscribe and STOP requests.
  • No infringement of intellectual property or privacy rights.
  • No interference with the security of the service: malware, probing, scraping, or circumventing plan limits.
  • No reverse engineering, resale or redistribution of the service.

5. Your content

You keep ownership of your contacts, campaigns and creative. You grant us a limited licence to host and process that content solely to operate the service for you.

6. Intellectual property

We retain all rights in the software, documentation and branding of Batsysmail.

7. Service level

We work to keep the service available, but we do not guarantee uninterrupted or error-free performance. Delivery of email and SMS also depends on third-party networks and carriers.

8. Payment, billing and subscriptions

Subscriptions renew automatically for the billing period you select until cancelled. Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our reseller under the Paddle Checkout Buyer Terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination you may export your data for 30 days, after which it may be deleted.

10. Warranties and liability

To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. We are not liable for indirect or consequential losses, including loss of profits, data or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not allow it.

11. Indemnity

You indemnify us against claims arising from your content, your messaging lists, or your unlawful use of the service.

12. General

These terms are governed by the laws of Ghana, and its courts have jurisdiction. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will post the new date above.
